The Civil Service Commission (CSC) has re-engaged retired government spokesperson Alpheous Nxumalo, but placed him on leave of absence pending the outcome of his ongoing court case.

Nxumalo’s previous contract expired on May 13, 2025, leaving the post vacant. Since then, Deputy Government Spokesperson Thabile Mdluli has been acting in the role.


Facing Rape Charges

Nxumalo is facing rape charges involving two siblings, aged 17 and 18. He has challenged the constitutionality of the Sexual Offences and Domestic Violence Act, under which he was charged.

The Civil Service Commission has renewed Alpheous Nxumalo’s contract as government spokesperson.

According to CSC Chairperson Simanga Mamba, the decision to place Nxumalo on leave follows the General Orders, which require civil servants facing criminal charges to be suspended pending finalisation of proceedings.

“The commission will await the outcome of the criminal proceedings to determine Nxumalo’s future in the civil service,” Mamba stated.

Contract Renewal Explained

Mamba explained that the CSC had already issued an offer of contract renewal to Nxumalo in February 2025, before his contract ended in May.

  • The offer was accepted by Nxumalo.

  • The renewal followed a recommendation from the ministry in charge.

  • CSC therefore confirmed the contract renewal despite the ongoing court matter.

Mamba emphasised that Nxumalo had a legitimate expectation of contract renewal based on the February notice.

“Nxumalo is innocent until proven guilty. Legally, the commission has no basis to withdraw the offer to his prejudice,” Mamba said.
